A Temporary Event Notice (TEN) is required under Licensing Act 2003 to license events which include one or more of the below licensable activities, when the event takes place on unlicensed premises or where an existing premises licence or club certificate does not authorise the required activities or times.

  • sale of alcohol
  • serving alcohol to members of a private club
  • regulated entertainment (where the activity has not been deregulated under Deregulation Act 2015)
  • late night refreshment (serving hot food or drink between 11pm and 5am)

A TEN should be submitted at least 10 clear working days’ before the event (you cannot count the day the TEN is served, the day of the event or any weekends/bank holidays). If the TEN is submitted with 5-9 clear working days’ notice it is classed as a Late TEN and should be marked as one in the relevant section of the form.

Limits

The notice giver/premises user must be aged 18 or over.

The event cannot carry on for more than 7 days (168 hours).

No more than 499 people can attend the event (including staff and performers at the event).

An individual can submit up to 5 TENs per calendar year (including 2 Late TENs), although this increases to 50 TENs per calendar year (including 10 Late TENs) for personal licence holders. Please note when an associate of an individual submits a TEN, or when an individual’s business colleague (where the business involves carrying on licensable activities) submits a TEN, this counts towards the individual’s limit too.

Each premises can have up to 15 TENs submitted against them per calendar year (or 20 times for events occurring wholly or partly in 2022 or 2023). These TENs cannot exceed a combined maximum of 21 days (or 26 days for event periods [or any part of those periods] occurring in 2022 or 2023).

How to apply

A TEN can be submitted online. This link takes you to the gov.uk portal where you can download a blank form, upload your completed form and make payment by card online. Please note when a TEN is received electronically (via gov.uk or by email) the licensing team will forward a copy of the TEN to the other parties.

Alternatively you submit a paper copy by printing the form from our downloads section. Once complete this should be posted to the licensing team at West Lindsey District Council and payment made by card, cheque or bank transfer. The notice giver must also send a copy to Lincolnshire Police's licensing team and West Lindsey District Council's environmental protection team at the same time. Postal addresses for all parties are provided at the end of the application form.

Objections

The licensing team cannot refuse a TEN unless the police or environmental protection team object to it. They must do this within 3 working days of receiving the TEN and can only object if they think the event could:

  • lead to crime and disorder
  • cause a public nuisance
  • be a threat to public safety
  • put children at risk of harm

If the police or environmental protection team object to a Late TEN then the event cannot go ahead.

If the objection is to a Standard TEN then a hearing must be held and a decision made at least 24 hours before the event (unless all parties agree that a hearing is not needed). At the hearing, the committee will either approve the TEN, add conditions to the TEN or reject the TEN. Appeals against decisions must be made to the local Magistrates Court within 21 days of the hearing, and at least 5 working days before the date of the event.

The police may modify the TEN with the consent of the notice giver, in which case their objection will be deemed withdrawn.

Counter notices may be provided by West Lindsey District Council if the number of permitted TENs has been exceeded.
