West Lindsey District Council has successfully prosecuted two individuals for failing to pay fixed penalty notices.
The offences relate to a breach of the Hemswell Cliff Public Space Protection Order which prohibits various activities. The initial fixed penalties of £100 issued to Christopher Usher and Amis Taylor, both of Buchanan Road, Hemswell Cliff were issued in April this year and were left unpaid.
The cases were dealt with via the Single Justice Procedure at Boston Magistrates Court on 1st August 2024. It resulted in fines of £220 being issued to each individual along with a victim surcharge of £88 and £89.79 in costs. The outstanding fines and costs are required to be paid by the 29 of August 2024.
Cllr Jim Snee, Chair of the Council’s Regulatory Committee said:
“We are pleased with the outcome from the court and hope that this demonstrates to our residents that where offences are committed we will pursue them to ensure that those that commit them are dealt with appropriately.
“The Council does not issue fixed penalty notices without due cause and will continue to use them where appropriate to ensure that our local areas remain clean and tidy and without nuisance.”
Under section 59 of the Anti-social Behaviour, Crime and Policing Act 2014 the council has the power to designate Public Space Protection Orders (PSPOs).
PSPOs are intended to deal with a particular nuisance or problem in a particular area that is detrimental to the local community’s quality of life, by imposing conditions on the use of that area which apply to everyone. They are designed to ensure the law-abiding majority can use and enjoy public spaces, safe from antisocial behaviour.
Failure to comply with the requirements of a PSPO can result in a Fixed Penalty Notice of up to £100 being issued. Non-payment of a Fixed Penalty Notice can lead to prosecution and a fine of up to £1,000.
