Litter

Litter is unsightly, dangerous to animals, and an offence. It can range in size from a single sweet wrapper, to a bag full of rubbish. The Environmental Protection Act of 1990 Section 87 (1) states that if a person drops, throws, deposits, or leaves anything that causes defacement in any place, they are committing a littering offence.

The Clean Neighbourhoods and Environment Act 2005 extended the definition of litter. It confirms that cigarette butts and chewing gum are litter - and anyone caught dropping them can be fined.

A fixed Penalty notice of £500 will be issued to anyone caught in the act of littering and a court does have the power to fine someone up to £2,500 (a Level 4 offence on the Standard Scale). This power also extends to anyone caught on CCTV committing the offence. It is also a criminal offence not to give a correct name and address to enforcement officers. Anyone who fails to give the correct information may be faced with prosecution and a fine of up to £1,000.
